A state in which I provide DMEPOS services recently passed a new law increasing the state’s licensure requirements for products I provide to Medicare beneficiaries. The new requirements are scheduled to take effect later this year. Will the new licensing requirements affect my bid in the competitive bidding program?
For competitive bidding purposes, any state licensure requirements that are implemented after the opening of the bid window will not affect the eligibility of a submitted bid. However, all suppliers that are offered and accept a competitive bidding contract must be in compliance with all applicable state licensure requirements at the time contracts become effective.
Suppliers are encouraged to confirm changes to licensing requirements with the respective state agency. The DMEPOS supplier standards require suppliers to keep their licenses current with the National Supplier Clearinghouse (NSC). Suppliers should consult with the NSC on timeframes to meet new licensing requirements.
