The Medicare Improvements for Patients and Providers Act of 2008 (MIPPA) designated the items that are included in the Round 1 Rebid. Specifically, MIPPA requires that we compete the same items and services in the Round 1 Rebid as were previously bid in Round 1 with certain limited exceptions. One exception is that negative pressure wound therapy (NPWT) items and services are excluded from the Round 1 Rebid. The other exception is that Group 3 complex rehabilitative power wheelchairs are excluded from the entire competitive bidding program. Therefore, the Round 1 Rebid will include the following categories of items and services:

It is important to note that we define an “item”, in part, as a product included in a competitive bidding program that is identified by a Healthcare Common Procedure Coding System (HCPCS) code. This definition can be found in the competitive bidding final rule published on April 10, 2007 (72 FR 17992). Therefore, we will conduct the Round 1 Rebid for essentially the same HCPCS codes that were bid in Round 1. This is necessary to comply with the final rule and MIPPA’s mandate to conduct the Round 1 Rebid competitive bidding program for the same items and services as the prior competition. However, we have made certain adjustments to the HCPCS codes that will be included as part of the Round 1 Rebid in accordance with 42 CFR §414.426. This section of the regulation addresses changes to HCPCS codes for competitively bid items. Also, in light of MIPPA amendments, we have made additional exceptions for obsolete codes and codes which are no longer separately payable (e.g., codes for oxygen accessories).
